Terms of Service
These Terms of Service govern access to and use of the MyTrackia service. By creating an account, you agree to these terms in their entirety.
1. Acceptance of terms
By accessing the MyTrackia service, creating an account or using the application, you declare that you have read, understood and accepted these Terms of Service. If you do not accept these terms, you must not use the service. MyTrackia reserves the right to modify these Terms at any time. Changes take effect upon publication. Your continued use of the service after any modification constitutes acceptance.
2. Service description
MyTrackia is a SaaS job application management application (CRM). It allows users to:
- •Create and manage a personal job application tracking space
- •Record and organize job offers
- •Plan and manage follow-ups
- •Track recruitment sites
- •Upload and store personal documents (CVs and cover letters in PDF or DOCX format)
- •Analyze CV readability by ATS systems (text extraction and automated, non-decisional diagnosis)
- •View statistics about their job search activity
- •Export their data as PDF
- •Use the browser extension to import job offers
MyTrackia is available in a free version (Free plan) and a paid version (Pro plan). Available features vary depending on the subscribed plan.
MyTrackia strives to ensure service availability 24/7, but does not guarantee uninterrupted availability. Interruptions may occur for maintenance or technical reasons.
3. Account creation and access
The service is intended for persons aged 16 and over. By creating an account, you certify that you meet the age requirement.
To access the service, you must create an account by providing a valid email address and password, or sign in via your Google account. You are responsible for the confidentiality of your login credentials.
You agree to provide accurate information and keep it up to date. MyTrackia reserves the right to suspend or delete any account with incorrect or fraudulent information.
You are responsible for all activity performed from your account. If you suspect unauthorized access, contact us immediately at: contact.mytrackia@gmail.com.
4. Use of the service
You are authorized to use MyTrackia only for personal and legitimate job search purposes. Any unauthorized commercial use is prohibited.
The following are strictly prohibited:
- ✕Using the service for illegal purposes or contrary to public order
- ✕Attempting to circumvent the application's security mechanisms
- ✕Sharing your login credentials with third parties
- ✕Using bots or automated scripts to interact with the service
- ✕Attempting to access other users' data
- ✕Intentionally overloading servers (DoS attacks)
- ✕Introducing viruses, malware or any malicious code, including via uploaded documents
- ✕Uploading files for which you are not the author or do not hold the necessary rights
- ✕Uploading files containing third parties' personal data without their consent
- ✕Uploading illegal, defamatory, hateful or infringing content
- ✕Uploading executable files or content unrelated to a job search (the service is reserved for managing job applications)
- ✕Using MyTrackia to impersonate another person
- ✕Reproducing, copying or reselling all or part of the service without authorization
5. Browser extension
MyTrackia offers a browser extension that allows users to import job offer information (title, company, description) from web pages visited by the user.
Users are solely responsible for complying with the terms of service of third-party websites from which they use the extension. MyTrackia does not encourage or endorse violation of third-party website terms.
The extension only collects data visible on the active page at the time of its activation by the user. It performs no automatic background collection and does not share extracted data with third parties.
Logos, trademarks and content from third-party websites belong to their respective owners. MyTrackia claims no rights over these elements.
6. User content
You retain ownership of all content you enter or upload into MyTrackia: applications, notes, job offers, recruitment sites, follow-ups, profile and profile picture (avatar), CVs and cover letters. MyTrackia does not acquire any proprietary rights over your content.
By using the service, you grant MyTrackia a limited, non-exclusive, non-transferable and revocable license to store, host, copy, transmit, display and process your content (including extracting text from your CVs for ATS analysis and generating thumbnails), for the sole purpose of providing the service. This license automatically terminates when the content or your account is deleted.
Uploaded documents (CVs and cover letters)
By uploading a document (CV or cover letter), you represent and warrant that: (i) you are the author or you hold all the rights and permissions necessary to upload it and to authorize its processing by MyTrackia; (ii) the document does not contain any illegal, defamatory, hateful or infringing content, nor any content that infringes a third party's rights (in particular copyright, image rights, trade secrets or third parties' personal data); (iii) you are aware that your document may contain special categories of personal data (Article 9 GDPR) and you freely choose to upload it. You may remove such information before uploading.
Documents must be in PDF or DOCX format. File size limits and the maximum number of stored documents depend on your plan (Free or Pro) and are listed on the pricing page. MyTrackia reserves the right to refuse or delete any file exceeding these limits or breaching these Terms.
You are solely responsible for the content you publish or upload and you warrant that it does not violate any third-party rights, applicable law or regulation. MyTrackia reserves the right, without obligation, to remove any content reported as manifestly unlawful, without prior notice, and to suspend the relevant account. Any manifestly unlawful content can be reported to: contact.mytrackia@gmail.com.
No content you save in MyTrackia is made public, shared with other users or indexed by search engines. Your data remains strictly private and accessible only by you (and, only to the extent strictly necessary for support, by authorized MyTrackia administrators bound by confidentiality).
7. Intellectual property
The entire MyTrackia service — including source code, design, interfaces, algorithms, databases, logos and editorial content — is the exclusive property of MyTrackia and is protected by French and international copyright law.
You are prohibited from reproducing, distributing, modifying, decompiling, disassembling or creating derivative works from the service without prior written authorization.
Third-party trademarks and logos (Google, LinkedIn, Indeed, etc.) belong to their respective owners and are used only for identification purposes.
8. Fair Use Policy
Certain Pro plan features are subject to a fair use policy. MyTrackia reserves the right to limit or suspend access for any user whose usage is manifestly abusive or exceeds the limits of reasonable use.
The term "unlimited" for certain features is understood within the framework of normal and reasonable use of the service, in accordance with this fair use policy.
9. Subscription, payment and right of withdrawal
MyTrackia offers two paid plans: a monthly subscription at €2.99/month and a quarterly subscription at €8.99 every 4 months. All prices are inclusive of tax.
Every new subscription includes a free 14-day trial period. No payment is charged during this period. At the end of the trial, the subscription renews automatically according to the chosen plan, unless cancelled before the trial ends.
Subscriptions renew automatically at the end of each billing period. You can cancel at any time from your account (Settings → Subscription → Manage subscription). Cancellation takes effect at the end of the current period: you retain Pro access until that date.
Payments are processed via Stripe, a secure payment provider. MyTrackia does not access your payment card details. In the event of a payment failure, your Pro access is suspended and you are notified to resolve the situation.
In accordance with European consumer law, you have a 14-day right of withdrawal from the date of subscription, without having to provide a reason. To exercise this right, contact us at contact.mytrackia@gmail.com. Refunds will be processed within 14 days.
However, if you have expressly requested to benefit from the service before the withdrawal period expires and have used it, MyTrackia may deduct from the refund an amount proportional to the portion of the service already provided.
Outside of the legal right of withdrawal, payments are non-refundable. In the event of cancellation during a billing period, you retain access until the end of the paid period with no pro-rata refund.
11. Limitation of liability
MyTrackia provides the service "as is" without warranty of any kind, express or implied. MyTrackia does not warrant that the service will be error-free, bug-free or uninterrupted.
MyTrackia implements reasonable backup measures but cannot guarantee the permanent retention of your data, nor the recovery of documents (CVs, cover letters) you have deleted. You are advised to keep a local copy of your important files and to regularly export your applications using the PDF export feature. MyTrackia shall not be liable for any data loss resulting from account deletion, a major technical incident or a force majeure event.
The ATS readability checker provided by MyTrackia is an overview and diagnostic tool, developed in-house based on public heuristic rules. It does not exactly replicate the behaviour of commercial ATS used by recruiters (Workday, Taleo, Greenhouse, Lever, iCIMS, etc.), which apply their own proprietary algorithms. A favourable score on MyTrackia improves your chances but does not guarantee passing the ATS filter of any given company. MyTrackia cannot be held liable for the rejection of an application linked to the analysis or non-analysis of a CV by a third-party ATS.
In no event shall MyTrackia be liable for any indirect, incidental, special or consequential damages resulting from the use or inability to use the service.
To the fullest extent permitted by applicable law, MyTrackia's total liability shall not exceed the amount paid by the user for the service in the preceding 12 months.
12. Termination
You may terminate your account at any time from the application settings (Settings → Account → Delete my account). Termination results in the permanent deletion of all your data within 30 days.
MyTrackia reserves the right to suspend or terminate your access without notice in case of:
- •Violation of these Terms of Service
- •Fraudulent or abusive behavior
- •Non-payment of amounts due (Pro plan)
- •Court order or legal obligation
In case of termination by MyTrackia for violation of these Terms, no refund will be issued.
13. Governing law and jurisdiction
These Terms of Service are governed by and construed in accordance with French law. In the event of a dispute relating to the interpretation, performance or termination of these Terms, the parties will endeavor to find an amicable solution. Failing that, French courts shall have exclusive jurisdiction.
For users residing in the European Union: you benefit from the protection offered by the laws of your country of residence to the extent that such protections cannot be contractually excluded.
EU consumers may also use the European Commission's Online Dispute Resolution platform.
14. Changes to Terms
MyTrackia reserves the right to modify these Terms at any time. In the event of a material change, you will be notified by email at least 30 days before the new terms take effect. If you do not accept the new terms, you may terminate your account before they take effect.
